"A Moody Update: The Supreme Court Decision"

Since January 2022, Oregon defense attorneys have struggled to make sense of the Oregon Court of Appeals ruling in Moody v. Oregon Community Credit Union, which seemed to overturn 45 years of Oregon law holding that first-party insurers cannot be liable for non-economic damages.  Following the court of appeals ruling, defense attorneys have seen an onslaught of negligence per se claims against carriers with little guidance apart from a growing body of conflicting rulings from the federal bench.  Throughout this fight, Oregon insurance law faced an all-pervasive question: what would the Oregon Supreme Court do?
Now we know: claims for non-economic damages against first-party insurers are here to stay…at least in some circumstances.  But we do not know how far that principle extends, or what local courts will make of the supreme court’s tantalizing statement that “this ruling is a narrow one.”  Does it apply beyond the fraught facts of Moody’s life insurance dispute?  Will it empower homeowners with a leaky shower, or corporations alleging emotional distress damages?  Will the legislature heed OTLA and enshrine portions of Moody into statutory law?
